Personal Data Registration

In compliance with the GDPR and the LOPD-GDD, please be informed that the personal data collected by WES Panel via the forms on its pages will be incorporated and processed in our file to facilitate, expedite, and fulfill the commitments established between WES Panel and the User or to maintain the relationship established in the forms completed by the User, or to address any request or inquiry. Furthermore, in accordance with the GDPR and the LOPD-GDD, unless the exception provided in Article 30.5 of the GDPR applies, a record of processing activities is maintained which specifies, according to its purposes, the processing activities carried out and the other circumstances established in the GDPR.

Principles Applicable to the Processing of Personal Data

The processing of the User’s personal data will be subject to the following principles set forth in Article 5 of the GDPR and in Article 4 and subsequent articles of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights:

Lawfulness, Fairness, and Transparency: The User’s consent is required at all times, after providing completely transparent information about the purposes for which the personal data is collected.
Purpose Limitation: Personal data will be collected for specific, explicit, and legitimate purposes.
Data Minimization: Only the strictly necessary personal data in relation to the purposes for which it is processed will be collected.
Accuracy: Personal data must be accurate and kept up to date.
Storage Limitation: Personal data will only be kept in a form that permits the identification of the User for the time necessary for the purposes of its processing.
Integrity and Confidentiality: Personal data will be processed in a manner that guarantees its security and confidentiality.
Accountability (Proactive Responsibility): The Data Controller is responsible for ensuring that the above principles are complied with.

Categories of Personal Data

The categories of data processed by WES Panel are solely identifying data. Under no circumstances are special categories of personal data, as defined in Article 9 of the GDPR, processed.

Legal Basis for the Processing of Personal Data

The legal basis for processing personal data is consent. WES Panel is committed to obtaining the express and verifiable consent of the User for the processing of their personal data for one or several specific purposes.

The User has the right to withdraw their consent at any time. Withdrawing consent is as easy as giving it. As a general rule, the withdrawal of consent will not affect the use of the Website.

When the User is required or may provide their data through forms for inquiries, information requests, or for reasons related to the content of the Website, they will be informed if any of these fields are mandatory because they are essential for the proper execution of the operation.

Purposes for Processing Personal Data

The personal data is collected and managed by WES Panel with the purpose of facilitating, expediting, and fulfilling the commitments established between the Website and the User, or of maintaining the relationship established in the forms completed by the User, or to address any request or inquiry.

Furthermore, the data may be used for commercial purposes related to personalization, operational and statistical activities, and for activities inherent to the corporate purpose of WES Panel, as well as for data extraction, storage, and marketing studies to tailor the offered Content to the User and improve the quality, functionality, and navigation of the Website.

At the time the personal data is obtained, the User will be informed of the specific purpose(s) for which the personal data will be processed; that is, the use or uses that will be made of the collected information.

Retention Periods for Personal Data

Personal data will only be retained for the minimum time necessary for the purposes of its processing and, in any event, for the following period: 36 months, or until the User requests its deletion.

At the time the personal data is obtained, the User will be informed of the duration for which the personal data will be kept or, if that is not possible, the criteria used to determine that period.

Recipients of Personal Data

The User’s personal data will not be shared with third parties.

In any event, at the time the personal data is obtained, the User will be informed of the recipients or categories of recipients of the personal data.

Personal Data of Minors

In compliance with Articles 8 of the GDPR and 7 of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, only individuals over 14 years of age may provide their consent for the lawful processing of their personal data by WES Panel. If the User is under 14, parental or guardian consent is required, and such processing will only be considered lawful to the extent that such consent has been provided.

Confidentiality and Security of Personal Data

WES Panel is committed to adopting the necessary technical and organizational measures, according to the appropriate level of security relative to the risk of the data collected, so as to guarantee the security of personal data and to avoid its accidental or unlawful destruction, loss, or alteration, or unauthorized communication or access.

The Website is equipped with an SSL (Secure Socket Layer) certificate, ensuring that personal data is transmitted securely and confidentially, as the transmission of data between the server and the User—and vice versa—is fully encrypted.

However, since WES Panel cannot guarantee the invulnerability of the Internet nor the total absence of hackers or others who might fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay in the event of a security breach of personal data that is likely to entail a high risk to the rights and freedoms of individuals. According to Article 4 of the GDPR, a personal data security breach is defined as any breach that results in the accidental or unlawful destruction, loss, or alteration of personal data transmitted, stored, or otherwise processed, or unauthorized communication or access to such data.

Personal data will be treated as confidential by the Data Controller, who undertakes, through a legal or contractual obligation, to ensure that this confidentiality is respected by its employees, associates, and any person to whom the information is made accessible.

Rights Arising from the Processing of Personal Data

The User has the following rights with respect to WES Panel and may exercise these rights against the Data Controller as recognized by the GDPR and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights:

Right of Access: The right of the User to obtain confirmation as to whether WES Panel is processing their personal data, and, if so, to obtain information about their specific personal data and the processing carried out or being carried out by WES Panel, including, among other things, information about the source of the data and the recipients of any communications made or planned.
Right of Rectification: The right of the User to have their personal data corrected if it is inaccurate or, considering the purposes of the processing, incomplete.
Right to Erasure (“Right to be Forgotten”): The right of the User, provided that current legislation does not provide otherwise, to have their personal data deleted when it is no longer necessary for the purposes for which it was collected or processed; when the User has withdrawn their consent and there is no other legal basis; when the User objects to the processing and no other legitimate reason exists to continue processing; when the personal data has been processed unlawfully; when the personal data must be deleted in compliance with a legal obligation; or when the personal data has been obtained as a result of a direct offer of information society services to a minor under 14 years of age. In addition to deleting the data, the Data Controller, taking into account the available technology and the cost of its implementation, shall take reasonable measures to inform the data controllers processing the personal data of the request to delete any link to such personal data.
Right to Restriction of Processing: The right of the User to restrict the processing of their personal data. The User has the right to obtain a restriction of the processing when they contest the accuracy of their personal data; when the processing is unlawful; when the Data Controller no longer requires the personal data but the User needs it for claims; or when the User objects to the processing.
Right to Data Portability: In cases where the processing is carried out by automated means, the User has the right to receive their personal data in a structured, commonly used, and machine-readable format, and to transmit it to another data controller. Where technically possible, the Data Controller will transmit the data directly to that other data controller.
Right to Object: The right of the User to object to the processing of their personal data or to have such processing ceased by WES Panel.
Right not to Be Subject to a Decision Based Solely on Automated Processing, Including Profiling: The right of the User not to be subject to an individualized decision based solely on automated processing of their personal data, including profiling, unless required by applicable law.

The User’s full name and a copy of their identification document. In cases where representation is permitted, identification of the person representing the User must also be provided, along with documentation proving such representation. The photocopy of the ID may be substituted with any other legally valid means of proof of identity.
The request stating the specific reasons for the request or the information to which access is sought.
The address for notifications.
The date and signature of the applicant.

II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY

It is necessary that the User has read and agrees with the conditions regarding the protection of personal data contained in this Privacy Policy, and accepts the processing of their personal data so that the Data Controller may process it in the manner, within the timeframes, and for the purposes indicated. Use of the Website implies acceptance of its Privacy Policy.

WES Panel reserves the right to modify its Privacy Policy, at its sole discretion or due to legislative, judicial, or doctrinal changes by the Spanish Data Protection Agency. Changes or updates to this Privacy Policy will not be explicitly notified to the User. It is recommended that the User periodically review this page to stay informed of the latest changes or updates.
